In the case of the engines he was selling one thing, a 427 that had been rebuilt, and shipping another, a 406 junkyard block. In this case he's selling a used vehicle which generally has specific laws about buyer protection i.e. mileage rollbacks and often little else, and his claims are defendable. Was the engine rebuilt? Yes. Poorly, and not completely, but within a broad interpretation it was. What does mostly rust free mean?

I'm not defending the guy. I'm no lawyer. I'm just saying I can't see how you're going to get anyone interested in suing this guy. You tell a lawyer you bought a vehicle for 5 figures off the Internet with no inspection, what's he gonna say?

you do not need a lawyer to sue in small claims court. at most, you need a small amount of help from a lawyer and plenty are willing to do that.

The current owner bought it from a self-proclaimed 'Cruiser expert' as a restored truck for a price well into 5 figures. A letter that accompanied the truck stated it had rebuilt engine/trans/t-case, new tires, paint, no rust, etc. As the truck is being repaired, it has become obvious that almost all statements made by the PO regarding the FJ40 are incorrect.

the owner may well have a claim. a lawyer would need to read the letter and investigate the rest of the paperwork and hear the details.

a lawyer could also tell the op if he has a jurisdictional right to sue in his home state.

might be worth a one hour meeting to find out. or he could chalk it up to experience.
 
I think the damages in this case are beyond small claims. Maybe not. IL hears cases up to $10k

If the guy has any sense at all he has no assets and even a successful lawsuit will likely net exactly what the guys in the engine case got - one check for $80.
 
i had been thinking the same thing, you invest hours and money, get vindicated in court but nothing back in $$$$.
the links show he knows how to play the game, even when he loses he doesn't lose the money people paid him.
he is a crook and with threads like this one on the net, if anyone does a search BEFORE dropping the coin, it might prevent more from falling for his scam.

sad that people like this dick can get away with blatantly screwing people over again and again and again...
 
He was convicted in 2005 and did 3years probation. But his current ebay user ID starts in june 2005. So as soon as he got out of jail, he went back to working the ebay thang.

Did he report to his probation officer that he was not messing around on ebay?
Or was the court OK with him going right back to the trough?

Likely, due the length of his sentence and his PSR, his USPO did not have to work too hard to keep tabs on him. They have a pretty full plate. I am certain none of that ever came to light. Dunno if there was anything in his disposition about not selling on Fleabay.

Some of you might be wondering just how good Jim is. Imagine Rainman, but instead of counting cards or toothpicks, he lifts the hood of your 40 and starts rattling off everything that is wrong with it faster than you can write it down who's on first. I was in Cincinnati recently, but not at Kmart to buy my underwear.

Jim you wouldn't happen to have a 4 blade fan laying around the shop. One of my blades decided snap off and lodge itself in the radiator. It prolly snapped off because that engine runs so damn good;)

As a matter of fact, I do have a perfect 4blade fan on the shelf. The only one I've had/seen recently that had no stress cracking at the hub or bolt holes.

You'll hafta come down here to get it, and bring me a 6 pack of IBC or Sioux City Sarsaparilla in exchange. :beer:
