This 1994 Toyota Land Cruiser FJ45 Bandeirante is for sale in Los Angeles, CA. This truck was purchased and lots of work was done on it in Brazil before being imported to the USA in December 2022. This is a limited edition Land Cruiser made for the Brazilian armed forces. Only 1470 were produced, and just under 500 in this specific configuration. How long has it been titled in California? Does the title list it as a Diesel? Was it tested and certified through CEE or was it titled through a different route?
From the seller, "Its first title was issued in the USA by the California DMV in September 2023, and it is listed as diesel fuel on the title. The car is currently in my name.
As for CEE certification, it was not necessary, as instructed by the California DMV. According to them, "Your vehicle does not need a smog inspection if your diesel-powered vehicle is a 1997 and older year model OR with a Gross Vehicle Weight of more than 14,000 pounds.” ( Smog Inspections - California DMV - https://www.dmv.ca.gov/portal/vehicle-registration/smog-inspections/ )"

Interesting. It appears to have slipped through a crack in the CA DMV / ARB procedures unless they also have a BAR Referee Label.

While it is true that a 1997 or older diesel passenger vehicle doesn't require smog testing, what California deems a "grey market" vehicle must be granted an exception from ARB. There are two avenues to get this exception - one is a certification from the manufacturer that the vehicle was made in compliance with the US standards in place in 1994, or to have the vehicle tested at an authorized lab (as far as I know only CEE has this designation to do the testing, but I'm curious to hear if that has changed). Prior to 2017 there was a third avenue (involving new residents to the state bringing in a "grey market" vehicle that they had owned in another state for at least a year) but this is no longer applicable.


"To be registered in California, grey market vehicles generally must meet the emission standards for the same model year vehicles sold in the United States. Requirements vary by model year and may include major modifications, a certificate of conformance from a California Air Resources Board (CARB) authorized laboratory, a BAR Referee label, and a Smog Check certificate."

Does the owner have a certificate of compliance and a BAR referee label? It would be good news if they did, and if so, I'd be very curious what process they went through.

Sorry to ask so many compliance questions but many of us in CA are getting burned when the DMV revokes titles and registration after they eventually notice that not all the boxes were checked.
