The insurance company offered up 3724.00. That's after they total the vehicle and I buy it back with a salvage title. They estimated the repairs at $7260.00 but refuse to fork out that money. I got them 2 estimates from local body shops one at $5100.0 the other $6925.00. They were not interested in repairing and say it's totaled. I'm not sure how they can say that since they really don't have and accurate value for my vehicle yet.

They used CCC1 a valuation software company..to come up with a value. Based on their
"take" prices from some used car lot on the other side of the U.S. they valued my ride at $4500 for a "totaled" offer. I told them I would not sign over title and surrender my 5 speed truck for that.

Here is a scathing report on "CCC one" in an article in Trial Magazine. Apparently the American Society for Auto Appraisers doesn't think much of this company.They say CCC one slant their evaluations to the low side to get about 85 percent of all Insurance Company business in the U.S. Here's the link to the article.

here's another link showing a class action law suit against CCC1 where they settled for 8 million for unfair valuations affecting consumers. Apparently 1.8 million still set aside for future payouts.

The CCC1 valuation showed only 2 comps. the one comp at 4800.00 but no pics of descriptions of their comp vehicle. They also had a fj62 (wrong model) for 4800.00 but not pics or discriptions. They de-valued my truck 300.00 for paint wear and dings. But added nothing for the 5 speed that I installed in 9/07 along with clutch, master and slave.


I told them if they would give me nothing more for the 5 speed then when I came down to it and if I did surrender vehicle that I would pull the transmission and find a 28 year old 4 speed and throw it in the back of the vehicle. The Insurance claims superviser didn't care much for that and warned me against removing anything from the vehicle after they had taken the pics and come up with valuation. I told him it was a two-way street. I didn't think they should get it if in their opinion it added no value and they were basing my valuation on a stock 4 speed truck.

Last we spoke he decided he was going to pay a Virginia auto appraisal company to come and do another valuation. Still waiting for a rental truck.

I did speak with some lawyers office. The high dollar lawyer won't touch it because their isn't enough money involved. And they charge 30 percent on a contingent basis. The less expensive and i assume less experienced lawyer was interested in taking it on for $200/hr on a non-contingent basis. This means the clock keeps ticking and I keep paying him no matter what the outcome.
 
Hold out. Time is not on the insurance companies side. You do not have to accept any amount they offer you. Contact your insurance company and find out what they say. But do not back down.

If you don't have a "stated Value" policy but but do carry full full coverage any options you had should be listed on your policy. Had friend who rolled his Hard Body Nissan pickup shortly after buying it new and adding a matching camper shell. It was painted to match and cost quite a bit. His insurance didn't pay a penny extra for the camper shell and only paid according to how the VIN said it was equipped. Had the same thing happen to me back in 04 when I totaled my Tundra. Since my insurance wasn't going to pay me for the options I told them I was going to remove them. While I flipped the truck on it's top it didn't damage the nurf bars or the fiberglass tonneau cover I added. My insurance let me remove them as well as the bed liner and tow hitch which I added. I got lucky as I installed all those on my next truck. If they had been damaged I would have just been out the money I spent. If your policy had stated the five speed on it you could have used that fact to help them raise their offer. If you had receipts for the conversions that would have been even better. Another thing to do if you buy a vehicle new or used and going to carry full coverage make sure you go over with your insurance agent everything on your vehicle to be sure it's covered. The dealer installs some high dollar wheels and tires those may not be covered. In the past my agent use to take pictures when I insured a used car which would show some options. Things like lockers and five speed would need to be pointed out.

I have FJ40 with a stated value but my FJ62 is only liability with glass and theft coverage. I don't have a stated value for the theft coverage. With the value of the 60/62 series starting to go up it's something I need to look into. Problem with standard full coverage policy with these vehicles is they are all over twenty-five years old and there is plenty of cheap well worn and rusted survivors out there for insurance companies to use to low ball their offer. I've gambled by carrying only liability figuring a accident causing damage around $4K the insurance company will total it. I could fix it for half that and still have a clean title. A salvage title doesn't say anything about how much damage only the insurance company totaled it. Anything 81 or newer (all 60 series) will have seventeen digit VIN and there is no way to hide a salvage title. As these continue to go up in value years down the road having spend a few thousand now could very well paid off by not having a salvage title.
 
years ago I test drove a vehicle with a "five speed transmission". Tried to put it in fifth and it wouldnt go. There was no fifth. It was a four speed with the shift knob off of a five speed. I wondered why the guy kept saying he didnt want me to go fast. Just sayin.

I'm dealing with the other parties insurance company. My insurance is not going to pay. I have talked to my agent who has given me advise but says it will do no good for him to get involved. It's been 10 years since I bought this truck and values have gone up. I didn't really know what they were selling for. If it doesn't get totaled I will put full coverage on it with a stated value.

I agree with you. I'm not interested in the salvage title option. If they don't give me a decent price for it or refuse to fix it, I will just fix it myself and keep going. At least it still runs and drives good.
 
The type of insurance coverage you have is irrelevant. She is at fault. She damaged you. Do not back down. Hold your ground.

Nothing scares or hurts an insurance company more than you holding out. They want to settle quickly. They prey on the fact that most Americans "NEED" to have their car back. They are obligated to provide you with a rental until you settle. That adds up quickly. I've totaled 4 vehicles (none of which were my fault). I got replacement value for all four. Two of which were 1-2 years old they paid full MSRP for them. But you cannot blink. It is a negotiation. The first person to throw out a number loses.
 
Raise the "appraisal clause" with the insurance company. I have helped out a couple of people in here and friends and family. If you want some advice shoot me a message. If you want to research about it on your on go for it but don't give in what they say. If they keep dicking you around tell them you are going to file a "bad faith claim" for toying with you. do your reading, get familiar with your insurance terms and you will come on top
 
BS(regarding insurance agent) your insurance is 1st, they pay you and go after the other party.....at least that's the way it works around here or I am missing something. 10 years ago, wife's 62 with 350k got hit, it was 100% the others drivers fault. our insurance totaled it, gave us a check for $8500, bought it back for $500. Then they went after the other guy. We did get a lawyer latter for the personal injury part, we had 300k in uninsured motorist, but as it turns out the kid lived at home, was his dads car. ...so they picked up the tab and wrote a nice check. My wife's shoulder is still messed up from the accident and surgery. But we had good insurance which really did pay off.
 
My insurance was liability only. No full coverage. No collision. My insurance will not provide me with a rental or cover the damages and try to recoup from the other parties insurance. This seems right to me but a friend says no that they should be more involved and should be fighting for me. I just don't see where my insurance company has any leverage.

Orig. sale price $17200. It scares me to think if I get in a wreck...
Heed what was said above, 'appraisal clause' 'bad faith claim' ...we have a deep well of resources here in the cruiser community.

Talk to your insurance agent. Be polite but FIRM. Ask why you pay money to the ins. co. but they do nothingggg for you? Polite but firm, until they answer this one question.

My agent has intervened in the past on vehicles that I only have liability coverage on. Then again maybe that's why I've had him for 23 years...

I have full coverage on my 60 which is likely the difference,but when I was in an accident, through no fault of my own, I tried to work with their insurance and it was a complete joke. I ended up going going through my insurance. Everything changed from that point forward. It ended up costing almost twice what their insurance was willing to pay. My insurance never blinked and ended up paying more to repair it than I did for my 60 two years earlier. They simply turned around and billed the other drivers insurance. It really was that simple.
