There is no way that won't be 'totalled'. Sorry to hear of that. That bumper part on the Xterra is one solid hunk, no?
 
As far as her spinning 360s..I thought about this too. I wonder if the steering got away from her ...or perhaps when she tried to brake ...the brakes pulled to one side w/out power to steering or brake. Also I wonder what the transmission was being told by the ecm when it cut off??? Did it slam into another gear???

My vote is that she had operator error. Driver malfunction
 
Makes you wonder if all this modern technology is so great after all.



It sounds to me like either operator error or the equipment are likely scenarios.
 
She has has previous issues with the ignition cutting out while driving and she still drove?

Yep. Lawyer. I'd also limit future comments about it as well. And get a lawyer yourself and do not ever talk to her insurance company. Ever. Let your lawyer do it.

I made that mistake once, I was honest, claimed I saw a yellow light (on a bicycle no less) and went through it. So did their client, in a car, turning left in front of me. Broke my hip when I hit her (I had right of way) and they paid not one cent. Since we both went through a yellow we were both at fault.
 
If I was laid up in a hospital bed with major medicals... I would def be lawyered up. Don't think any lawyer would be interested in peanut $$ that we're talking about today. Hell I would prob be paying the lawyer more than the insurance pay out.

your insurance is not gonna pay what a clean 60 is really worth

and the insurance payout covers the lawyer cost as well. No money out of your pocket and you get your 60 fixed, properly. Remember, this was someone else's fault/negligence, no reason you should be affected in ANY way.

just how I would handle it if someone totaled my Cruiser.
