Sorry to see this...I feel your pain. :mad:

Given the 'cash for clunkers' programme creeping around the world, and slowly taking very useable vehicles off the road, I align the insurance companies with the same thinking, get the 'ol banger' off the road, and the very nature of humans is to buy a newer vehicle. But unless the owner of the insurance company has owned an 80 then this will get totalled.

Hope this all comes good for you, I note no injuries, that alone has to be a plus point?

Thanks Dave, no serious injuries, whiplash but happy to walk away. The Officer on the scene told me if the truck had been just 6" closer to the curb it would have caught it and rolled over, maybe even crushing the A pillar and my Cabeza.

It really sucks the way the system forces out well kept vehicles because they're old, keeping it on the road so long as it's maintained is actually the far greener option to buying new.

Exactly, I've pondered replacing this truck many times (just as an experiment) to see what compares. Verdict: No results - There's no substitute for an 80 series Land Cruiser except another 80 series Land Cruiser.

This is just silly. As decoco said, there are so many factors that go into whether a vehicle rolls or not, that is an absurd assumption, even if he happened to be right. Also, the A pillar will NOT crush in and your head will NOT be crushed. That would take way more concentrated force than rolling over on flat ground can apply. I have rolled an 80 (1.5x) at highway speeds and the A pillars held up very well. I have also flopped on the trail right onto the A pillar and it help up just fine. Every situation will be different but to compromise the driver compartment (the holy grail of auto safety ratings) takes a lot of either repetitive or concentrated force.

This means that they either have to pay for repairs to make your vehicle the way it was before or buy you an equivalent vehicle. They cannot 'total' your vehicle if you choose not to let them. You have no written agreement with them. Don't sign anything. If they won't pay you what it takes to either buy a vehicle that is equivalent in maintenance, miles, year, accessories or fix yours, then don't sign anything and get a lawyer. It wasn't your fault that the person ran into you, and it shouldn't cost you a dime.

I think maybe *Officer Bob* was just trying to make me feel better, seemed genuinely nice to me, tho he didn't say it was her fault, we all know it was her fault.

And I did overhear the cop telleing her "I'm citing you for failure to yield right of way" and possibly a second citation I didn't hear. Didn't wanna seem like I was eavesdropping but I heard that much.

Thank you sbman, this is the most reassuring thing I've heard. Even tho it's totally her fault I'm likely gonna get an Attorney.... Or 2.

depends on the state and who her insurance is. the lady that hit me had the same company so i was basically SOL and i cant sue for property damage when i have insurance of my own to cover my loss. now my insurance company could sue for me since i had to file under my UI policy but they arent going to sue themselves so... i am getting the short end of the stick here.

Sorry to hear, that really sucks.

Thankfully the girl who hit me has a different insurance than I do. She has Progressive. Which I think is good news for me since I had good experience dealing with them a while back (other person had Progressive)
 
And I think I underestimated the whip lash. Feeling worse on day 2. :wtf:

Also, checking my mail box today, received the tail light I ordered which was gonna be the final exterior piece to what would have been a perfectly clean body. :(
 
Obligatory "that'll buff right out" comment - but seriously check the frame and axle housing. If the axle housing isn't seriously bent you may be okay, and don't sign anything from Progressive whatsoever without consulting a lawyer. They can't total your vehicle if you don't let them iirc - they have to fix it if you insist. Even if I'm wrong and they don't, being sufficiently obnoxious may get you where you want to go. Keep us updated.

Just a couple bumps and bruises. On looking back at the pics, the PS A pillar did collapse a bit but it was the initial point of impact at 60 mph--still pretty good IMO. When resting upside down, the roof was supported by the PS front seat--A taller passenger would have had a bit of a headache....

Ouch, looks pretty bad but if you walked away with just bumps and bruises at 60mph I'd say it held up ok.

Did airbags deploy? Makes me wonder if old air bags are still gonna do their job.

That is a 93 or 94 model that doesn't have air bags.
 
Whiplash is something that is common to have further issues show up weeks after, don't sign any release of liability or even take compensation if it is a release of libility (common language buried in the disclosure form when the ins comp mails a check).

Lawyers, guns & money - 3 things you can never have too much of.

And never play Perry Mason, a man who acts as his own lawyer has a fool for a client.

You can get them to either repair (or show them a 175K 80 in good shape is now appreciating, partly due to low gas $$) - what was a $5K 80 2 yrs ago now I bet is $6500-$7500, use the Mud Classified ads to show quality 80 prices.
