I think that if they replace the frame and extend the warranty out for any frame related issues they will have met thier warranty obligations. That may not be the best business practice but I doubt you could do better in court or mediation.
I think OKing the frame replacement and asking for or even buying the Toyota Corporate (Gold-plated) extended warranty may be your best option.

How much can you get if you trade it in for a 06 LX w/ vvti?

$40K -- KBB exlnt cond.
AutoNation said they would simply put it back into the food chain via auction... they didn't care if the frame was fixed or not, as long as it was covered under warranty.
I would need to fork out $29-$32K to get me back where I am today with an '06.
In essence I will burn through $40K in capital on two new Land Cruisers in a 12 month period to make this right -- that doesn't account for depreciation on the new purchase.
It doesn't make financial sense now... I was planning on upgrades, OME, ARB, and stuff, and keeping my LC for at least ten years. I can't do that with this vehicle without getting into a pissing contest with Toyota on future warranty claims.
At this point I would probably trade-down before taking a hit like that -- down as in paying cash for a Trailblazer SS and have some fun. Although my LC is more luxurious and suits my needs better -- I kinda miss the fun-factor I had with my Plymouth on those special occasions.
I don't like debt -- especially when it means pouring more money into a company that just screwed me out of $20K. If Toyota changes their tune and wants to negotiate, then I'm open for the discussion.
Its now a matter of principle.. I've already lost the $20K. I'm a key-stroke away from sending my story to the local paper -- the Orange County Register to be exact... taking a photo shoot at Toyota Motor Sales U.S.A., Los Angeles Regional Office [parking lot] in Irvine, California is nice place this time the year -- it's only 30 min. from my home in SoCal. Maybe the dealer or someone from Toyota will read this and take note.

I would first get a copy/order the frame replacement under warranty as proposed by Toyota. Then I would contact Toyota and ask them if they want to buy the car back. If they say no were going to fix it after you tell them about the potential safety issue based on the article from there chief engineer, then I would ask them if they would like to have a representative available for the pictures infront of their HQ and to comment for the article that will now be written. Make sure you have a reporters name that you can throw at them. Also make them aware of all your issues. Guess it might be better to give all this to them in writing and sent it to their top guy. Good luck
PS - If none of this works then I would let them replace the frame and ask for loaner car benefits whenever they have a warranty issue on your LC. Too bad this isn't a Lexus you would get all of that stuff automaticly and then use their vehicle and gas everytime.

You get free gas? I get billed for the gas. It's put on the misc expense, comes out to about 10 cents/mile. When the GX470 debuted in '03, there were some complaints of the tranny not being smooth, clunks, etc. Lexus ended up buying a number of them back.

Well, it's in the hands of the Toyota gods now. Maybe if we chant buyback, buyback, buyback, buyback, buyback ... together, good things will happen.

I'm a slow learner.
As a toyota owner for 25 years, none of this surprises me. They make some of the best vehicles on the planet, but they deliver some of the absolute worst service I've seen in my life. (CDan excepted, of course.)
Lexus is only marginally better. I once offered to bring my Lexus service manager to the Mercedes dealership so he could watch the way it really should be done. The difference in service level is amazing.
If I ever stop driving Toyota products, it's surely going to be because of the service, not the vehicles.

I've had just the opposite experience over the last 22 years. I've owned 4 Toyota's and 5 Lexus. Always gotten great service and they were always great to work with. I've owned 2 Mercedes and the dealer experience was OK nothing special. Based on the national studies Toyota/Lexus is head and shoulders above Mercedes in all measurements. So our personal experiences don't really mean much.
Toyota service almost always ranks below average in national surveys despite having much better vehicles. Lexus does very well. I really don't need Toyota to match Lexus or MB but if they were as good as GM it would be nice. Interestingly Toyota is always tops in dealer service performance in asian markets so they obviously know how to do it.

WRT the JD Power survey, that's really poor. In fact, when you factor in reliability, it means that Jaguar must be working about 10x harder than Toyota to keep people happy.

With both Toyota and Lexus, I've had quite a few of those experiences that leave you both angry and amazed for days on end. I've tried multiple dealers in the area, and got consistently bad results.
With Mercedes, they meet my wife at the curb and move our two kid's carseats to the free rental car. They fix burned out bulbs without an appointment while you wait, without even asking your name. They've fixed out of warranty things for free because "it really shouldn't have happened."
I agree my sample size is small compared to the national average, but I went from Toyota to Lexus in hopes of better service, and I came up empty.
I think that a big part of my particular problem is that the local Lexus dealership is also owned by my least favorite of the Toyota dealers. Any time you get a good service writer you can trust, he gets fired for not meeting his quota. They short staff, so you often wait in line 30 minutes to pay a cashier that is doing double duty answering phones. I once waited two hours for them to find my keys, which it turned out they accidentally gave to another customer. It all ads up and leaves a very lasting impression.

that's a good end to this portion of the story. i was really blown away by what's been happening to you.
i actually began considering other vehicles based partly on the fact that a TLC was 1. having frame issues and 2. not taking care of them. all i could think about was how angry i'd be if i just dropped the best part of 60K and was going thru something like that....
i started shopping mercedes really hard, as the SUV will largely be a grocery getter around socal for the next several years. what i found was that it's all the same. yesterday i had two mercedes dealers make me so mad that i will not own one of their vehicles, EVER. i actually came back to deciding on the TLC as the SUV for me last night. came by this forum to read about how your situation was coming and i'm really really glad to hear it has improved.
so as the previous post inquires, LC or LX?
