What I have read about OBD-III is that it will use roadside sensors rather than cell phone type technology. In fact, the infrastructure needed will facilitate "self-driving" roads where your vehicle maintains speed and distance without your input. Ford has had cell phone narcing for years. When they first gave away built in cell service most owners had no idea their car was sending recorded telemetry to Henry at night. I remember it caused a stir. You have to wonder if GM is using On-Star info to gather data about it's owners.
I understand that OBD-III is being tested in some states already. The two ways they are planning on getting around your 4th and 5th amendment rights are by charging you extra if you opt to be tested the old way and by sneaking a form in with the rest of your purchase paperwork.
I'm on the fence about it. If it was just emissions I could live with it, even though I would have been in violation the last year or so my CE light has been on. It would eliminate my bi-yearly trips to the emissions station. Once they start using the info for other things, it could get real big brotherish. I mean, we are talking about the same governments that sell the information you are required to give them to anybody who asks and they don't even charge much!

GM already has the OnStar set and ready to go .
Hell the radio adds even say it in a round about way (Mr Jones your air bag has gone off etc) OBDII already rats you out if you plug in and print codes . Air bag went off at 40 mph with your foot on the brake for x amount of time ABS pump working or not seat belt on etc . If the codes get pulled when your in a fender bender after telling them you were on the brakes and doing 25 but they see you were doing 50 and no brakes = Game Over :'(

Hook me up Koffer, please. No, was not entered into their system at all. After I waited 1-1/2 hr in line, they put a tape measure to the rear corner of the driver door and told me I was more than 4" over stock. I said, uh, yeah, no sheet. Then they said bye bye and gave me the number for tiltworld in MoTown. I'd prefer not to have to go through that, but if I do, then I will put on the swampers and go over. May as well only do it once. They told me if I came back for another inspection and I was higher than stated on the tilt slip, that I'd have to go through it again.

Here in Georgia, if you have a 96 up (as Instigator stated) they check by hooking up through OBDII. If it has been reset (Yes some diagnostic software can clear) they will not pass you. Where as if you have a 95 you can reset without being penalized because they just run a sniff test.

That is basically it.

There is a big difference between resetting and using the appropriate software to clear fault code from memory. I think that is where the confusion was.
