Ok need some help here.

The adjuster is finally going to come out one of these days soon. Well i have an idea they are going to try and possibly pay me the money to fix it and i can keep a good title, which is nice or they might find that it is too far gone and pay me the price of what they think it is worth and then i can buy it back. Then it will have a salvage title. I know i can fix it , just not too sure of the hours it will take to swap frames / front clip / pull engine,tranny,x-fer to make sure thay are all still good. And to replace all under the hood that is bad, which is alot from the exhaust forward i am afraid. I know it had to pull something apart on the exhaust as the engine is 5 inches forward.

Will an attorny help me with this even though i really never got injured ?
 
Just talked to 2 of them and they said no one will touch vehicle stuff. Was told there was nothing to be made on it.

Yea for me.
 
They'll never pay to have that fixed..... I know tons of claims adjusters back home and when there is frame damage to a 10+ year old vehicle unless it is a collectors car or really valuable it is always a write off.
 
Thats what i was thinking also.

Adjuster has not called / come by yet .

I do have a garage here that will give me receipts for the bumpers.
 
just hold out and and dicker with them if they try to low ball you. remember sometimes it takes a few days for symptoms to show up, so if your not feeling 100% let them know get it checked out now before you settle.

It might even be a good idea to search the market for some 60's in simular condiftion as yours, so that you can show what the current market value is and get supported documentation to back it up. the need to replace your vehicle not give you some wholesale black book auction price.

If any portion of a claim is found to be fraudulent, the carrier has the legal right to deny the entire claim and pursue felony fraud charges. This is something they take very seriously, and rightfully so. Start posturing this way, and the lawyers get called in quickly. I think Daren's claim is going to be hard to quantify, but with time and effort he should be able to strike a deal that will be fair. All this is assuming the vehicle was fully insured. Sometimes, they'll bust you because you were paying to insure a vehicle of x value, and didn't opt to increase the value based on condition / upgrades.

All of this talk has me considering upping my 40 coverage to collision, given the amount I have invested in part and all. It hardly sees 100 miles on pavement a year, so that's a tough pill to swallow.

'82 toyota land cruiser (fj60)

Just saw this, FJ60 needs a motor, might be a good option to find a non running 60 and swap in your parts?

Thought this was a clean looking 62

I would not play "too much" hardball, but here is what you want to do.

Find 1/2 a dozen ads for Land Cruisers in similar condition, and print them out. Have them sitting there with you when you meet the adjuster.

If you want to keep the truck, you negotiate the total payout and then subtract the salvage value (Which is all they will get out of it if they take the truck)

But if you can show definitively the true replacement value of the truck it is much harder for them to mess around.

IF THEY will not recognize your actual replacement value, you want to contact YOUR insurance company. Take in your data from above and ask if they will pay you instead and then THEY (your insurance company) will sue / pursue THEIR insurance company.

But you are then out of the loop and no longer have to worry about this. As a good customer, your insurance company should step in here and fight for you..

Years ago, I helped someone with a claim on a Jeep I sold them. I literally went through a 4x4 magazine / internet and copied, printed out an ad with every single replacement piece. (Bumpers, winch, replacement Jasper engine, etc)

Created a quick spreadsheet for a stock YJ, added those up and gave them the paperwork. They cut the guy a check for what he needed. DOCUMENTATION is key...PROVE what your truck is worth.

let me clarify, I'm not suggesting doing anything fraudulent. I have not seen Darin's 60 but i have seen his other rides and they are over the top, so looking for examples representing equal value/condition aren't going to show up the in the local paper. it will take a little work to document a like vehicle.

as far as coverage goes we all pick coverage levels and deductibles we can afford and live with. thus knowing the risk and we drive accordingly. i manage that risk and if i mess up then i am expected to pay. regardless off my coverage level if i hit someone else then my insurance should provide repairs or replacement for them, and my vehicle will handled based on my insurance coverage, meaning i may not get anything if i only carried liability. So, in Darin's accident if it was shown to be the other parties fault and they have insurance then Darin's insurance company is not involved at all and nor do his coverage level matter. if the other party didn't have insurance then Darin's insurance company would get involved and help, at this point insurance coverage levels would come into play. What Darin needs is fair market value for a similar vehicle anything he can provide to help document that is not posturing or fraud it's just good sence.

Duh, I forgot we were talking about "their" insurance, not Darin's. Not his fault - not his carrier's liability. Notice it was pretty late at night when I posted.
 
Thanks guys. Yes i am not out to try and fraud anyone here. I do not live my life like that. I would just like to have my cruiser back or be able to buy another like it. I am going to rebuild this one and have already told them so. So when the adjuster comes out and he also thinks it is rebuildable then we will go from there. I have also told him i will be doing all the work myself because no one around here knows anything about these vehicles.
 
Not too sure how it is coming out but the adjuster came out today. He did know my vehicle. Had seen it numerous times in town. I was not here but had left the wife with alot of info. He is going to try his hardest to not total it but if it gets above so much then they will. Already have my ideas about that though. He did let us know where there is an excelent frame shop in Laurinburg though. He thinks it can be straightened which is great info.

Will find out the results on Tuesday. He does know what these are running in this shape though. He did do some great homework.

Ramon, i have seen threads on this indicating ins companies will not provide collision for a car that old... will yours? i have considered the same thing

Theres a guy here in charlotte who has 2 fj62s. One is in great shape body wise, has a roof rack and an ome lift, the other has a good engine and a rusty body. he wants 2500 for both i believe. hes had them for a while so you might be able to work a deal with him. When i went by his house the good one looked to be in solid shape just needing the engine to be dropped in from the donor vehicle... Hes on craigslist.
 
Well, Took the front bumper off and hooked the spring hanger back up. Had done a shackle reversal years ago, Never again though. I think that is why this thing dropped so much on the front end to get the rear to come off the ground when i stood on the brakes prior to impact. I also seen where my spare tire carrier got my back hatch also. It is about 3 inches away from it normally, so it flew forward hard also on impact. I forsee alot of work getting ready to start.

You mean the one I posted up in post #31 ;)

In an older post he also had an ARB front bumper but he must have sold that one.
 
One option, sue her in small claims court after you have the cruiser fixed,for the exact amount you spent on the repair. Medical would be on her insur. co. MIke
 
Have to see tomorrow what the adjuster says. One way or another i will rebuild her and build her better. Could either be the easy way or the hard way.
