So I tried to be kinda nice and told him that I hadn't reported him, and that maybe I should get some kind of advertising compensation, just trying to give him a chance to defend himself and maybe say sorry......but, he was a total jerk. He said,

"I have six Ebay acounts so I don't care, and I didn't sell the vehicle. I don't see any license or house # so the FJ picture was mine."

What an ass ! I wish I knew what dealership this was so I could talk to the G.M. This was a dealership in Ohio. Anyone have any more info than that?
I didn't care all that much until he was rude, now he can :flipoff2:

Any suggestions?

Thanks,
Kathie

Report him for sure.

sadly, the concept of intellectual property is almost dead. even if you had a copyright registered your picture of your cruiser it would be a long and arduous process to be compensated for the theft. About the only thing you could do would be to buy a watermark and hope for the best...
but go ahead and report him.

On another board we had some issues with a salesman from what I think is the same dealership.

Brunswick Auto Mart
3031 Center Road
Brunswick, OH 44212
Phone: (330) 273-3300
Fax: (330) 225-5426

I think you should get some mud members in that area to find out the exact dealer and post it up here so voodoogirl can call up the manager of the dealer.

There is a word for a guy like that - ASSHAT.

Let the guys on Pirate at him!

copyrights do not have to be registered, since 1978, a copyright is automatic and created instantly so long as it is an original work, however to pursue it would be a PITA, but it would be funny to file a small claim and force him to come defend himself which would still be more work than it's worth.

Kind of looks like there is only 1 Toyota dealer in Brunswick OH. I'd maybe give them a call or look up their online inventory to see if it matchs and if so speak to the manager if you are that irritated by it.

This is something that eBay takes very seriously. The eBay legal team has a program called VeRO (Verified Rights Owners) that deals with IP violations. This was done in order to prevent eBay from being liable for infringing on IP rights. There is an internal team of people that investigate each reported issue. Please report him to eBay via the link available in the help section -- search for "picture theft".

I'm not trying to be confrontational but what copyright has been infringed upon?
thanks

nobody?

Doesn't voodoogirl have a copyright interest in the photo? I thought they were hers.

Anyway I don't think you can get punitives if your copyright is not registered. Something like that, anyway.

You can VERY easily file a small claims suit and have the owner of the dealership served to appear in court. It is one of the VERY few remaining contingencies citizens have when fighting large corporations i.e. embarassment.

I'm not too far away from Brunswick.

Let me know if I can help in anyway. Drop me a PM.

Best.
