Just as I stated on Land Use Issues, there is a new meeting with the Chattanooga City Council on July 28th at 6pm and that is on a Tuesday. The landownders that are fighting to keep it open said that they need anyone who wants the road to remain a public road and open that they need to show up and show their support. If you want the address or more details of where the Council will meet then just let me know and I will post the info. Thanks

Another change. They are going to keep changing this for a reason. But ha that works more into my favor anyways.

A group led by Doug Stein has withdraw a request to the city of Chattanooga to abandon the portion of Aetna Mountain Road that is in the city.

The Planning Commission voted in June to recommend closing public access to the old dirt road in Lookout Valley dating back to the Civil War.

However, the County Commission declined to act, noting that Chancellor Howell Peoples ruled several years ago that it is a public road.

City Attorney Mike McMahan said the Stein group wants to build a new road up the mountain to thousands of acres it owns there and build expensive homes on the mountaintop.


He said the length of the road is about 7,000 feet.

He said there are so many four-wheelers going up the mountain that the Stein group does not believe it can get the road rebuilt with all that traffic.

City Attorney McMahan said he suggested to the group that it obtain a group of temporary closures as the road was being built. He said a temporary road could be built around the section being improved.

But he said the group wants to try to work with existing landowners on the mountain.

One of those was at the City Council committee session. Jeff Perlaky said he plans to file a lawsuit soon - apparently against the Stein group.

The Perlakys and Jeff Fox are longtime foes of the closure. Mr. Fox, who won the 2004 Chancery Court ruling that it is a public road, recently said the case appears headed for court again.
