I have had a slight leak in an upstairs bathroom since shortly after I moved into my new home 9 years ago, it made a stain in the ceiling below, bathroom is only used by house guests so I have been slow to fix it, today I cut open the ceiling under the tub expecting to find a leaking drain or over flow but after fillign the tub neither seem to leak.

after looking around I think the tub spout may be the source, if I splash water on it simulating a shower it shows up downstairs,

so what was suppose to close that out and keep water from getting behind the tub surround? is it just suppose to be sealed with sealant or is it missing a ring or grommet or something? I pulled the spout off and there is just a hole in the surround.

one other question, I am about to sell, is it best to tell the new buyer about this show them the pictures and explain or just fix it and say nothing? is there any legal or moral requirement to disclose repairs that have been properly completed?

I do not want to give potential buyers anything to worry about on something that has been properly fixed,

Slap some silicone caulk around the spout.
When we sold our home last year, our realtor gave us a disclosure form to fill out. I guess it was just voluntary to admit any defects/damage to the home (I guess thats the buyers - home inspectors job to check everything out)
I would do the repair..... let it dry out for a few days..... test the drain and splash some water to see if it still leaks, and yes take some pics for the buyer so he feels confident that you are disclosing the repairs.

When you caulk the spout & it fixes the problem, you shouldn't have to disclose it if you don't want. I don't think there would be any moral issue there.
 
cool Thanks guys I'll pack the hole with sealant and see if I can get the spot to get closer and then seal around it also.
 
Install the spout dry and draw a line around the outline of the spout. Take the spout off and put a heavy bead of caulk following the line. Reinstall the spout until it "sets" into the caulk. Smooth the outside caulk with your finger.

We call this "wet setting". This is a much better installation than just caulking around the installed spout, as the caulk bead is much bigger and will not have a tendency to pull out.
