Organizing a Wheeling Event - Waivers, Insurance and Liability

Been having an email discussion about this topic and just wanted to get some input from some of you folks who have helped to plan and organize events. Most places that allow you to wheel have a waiver these days, but in our "sue happy" world, one can never be too cautious or protected against such things.

Please discuss and offer up insight as to what you and/or your club/organization has done to handle the legalities of organizing/sponsoring a wheeling event.

You may need to clarify where this event will be held. Private or public land?? If its on private land I would say the first thing the land owner should do is look into getting insurance. (I am not talking auto or life insurance) I organized an event in September on private property and the land owner bought insurance for the weekend. I believe he did this through the help of the Midwest 4 Wheel Drive Association insurance policy. This type of insurance covers the land owner. Each person that went on the trails was required to sign a waiver also. Granted most of us know the waiver may not stand up in a court case. The land owner where my event was held has been around offroading for years so he was familiar with how he could protect himself. I know in the state of Iowa by law a land owner can not be held accountable for "recreationalizing" on his land if he isn't making a profit. In my event all entry fees went to the land owner to pay for camping and land use. Maybe you could speak with someone from United 4 Wheel Drive Association.

TLCA offers most excellent (and cheap) insurance for sanctioned events hosted by the various chapters.

So join TLCA, form up a chapter and get 'em voted in, and have a large time. :cool:
