Welcome to the New Mexico Off Highway Vehicle Alliance's newest way to keep our members informed. As the 2009 New Mexico Legislative session approaches, it became obvious to us that we need a faster, more efficient, and more effective way to keep our members up-to-date on legislation affecting OHV use in New Mexico.
We will be sending Legislative Updates as needed throughout the 60-day session to let you know what is happening and what you can do to influence the New Mexico Legislature.

Status of Senate Joint Memorial 40 Study and Survey

In January of 2008, the NM Legislature passed Senate Joint Memorial 40 (SJM40). In this Memorial, the New Mexico Energy, Minerals, and Natural Resources Department (ENMRD) was instructed to partner with four other state agencies and complete a study to "conduct a study and recommend actions to resolve user conflicts, prevent future resource damage and provide greater
safety protections for motorized recreation users."

The wording in SJM40 makes it very clear that this was intended to be a OHV 'witch hunt'. The language of the Memorial was extremely negative, focusing on resource damage, cost to the state, accident information, and impact to forms of non-motorized recreation.

They were further directed to report their findings and recommendations to the governor and the appropriate interim committee of the legislature by December 31, 2008.

In mid-October, a survey was released by a contractor working for ENMRD. NMOHVA found the survey and the contractor to be extremely biased against OHV and sent a strongly worded protest to ENMRD and all members of the NM legislature.

ENMRD chose to ignore our concerns and the study continues. We expect the study to be delivered as directed near the end of this year. Considering the history of SJM40, we fully expect the study's 'conclusions' to be blatantly biased against OHV recreation and expect the study to be used as the basis for anti-OHV legislation in the coming 2009 session.
