On February 10, 2009, a new law called the Consumer Product Safety Improvement Act went into effect. This law was created by Congress last August as a knee-jerk reaction to hazardous toys being imported from China (remember the Fisher-Price toy recalls). It bans all products sold for use by children which contain above certain levels of lead and phthalates. In the act, children is defined as anyone 12 or under, and the law is very broad in that it exempts no products from its purview.

How does this become an issue of importance to motorcycle riders?

All minibikes and pitbikes fall under this act, as well as ATV's sold for youths. 85cc or smaller, gone. I can't get parts, I can't even get stickers. As of today, all the major motorcycle and ATV manufacturers have instructed their dealers to remove all bikes and ATV's used by children from inventory and to cease advertising, marketing, selling, possibly servicing these products. The lead contained in these bikes is not in the paint; it's in the metal used for certain parts in the engines and electrical parts. Most dealers have also been instructed to stop selling parts and accessories for the bikes as well.

The Consumer Product Safety Commission, CPSC, which is the commission charged with enforcing this act has been asked by the motorcycle industry to grant a waiver to prevent the end of the motorcycle industry, but they are dragging their feet. As a result, minibikes and pitbikes became illegal today.

What can you do about this?

We are sending this email to ask you to band together as the motorcycle community to tell the beureaucrats in Washington, DC that they need to act and act now to stop this from hurting the motorcycle industry any more.

116th District Missouri Representative Tom Self, father of two kids who race bikes, has organized a campaign to contact our legislators and the CPSC to demand that they act immediately to grant the waiver to the motorcycle industry. This campaign relies upon everyone who is involved in any way with motorcycles and racing to get involved and send a message. That's not just one representative of the family, but Mom, Dad, sister, brother...everyone! To make this easy, Representative Self has created a website with a form which can be used to generate letters to all the involved officials. Every member of your family who is a citizen of the US must be encouraged to send in this letter. Contact everyone you know who is involved in racing and get them to send a message. It is important that Washington DC be totally swamped with emails and phone calls about this, and it must happen right now!

50cc bikes are now being sold. They have a 1 year exemption from enforcement. Hopefully legislators can come up with a plan before this expires.
 
with all the problems in the world, the government still has time to worry about 50cc motorcycles...!!

Kids have two options

1. go in the right direction in life
2. go in the wrong direction in life ( drugs, crime etc.)

there are only so many available activities for a kid to do in the good direction and only so many activities in the bad direction..

by taking away the 50cc pitbikes it takes away from the good direction options... leaving more of a chance for the kids to go in the wrong direction.

if the govt. thinks this option will save kids lives or keep them from getting hurt.. then they obviously dont understand the alternative!!!

Congress passed a law banning imported toys made specifically for children with a percentage of lead in the toy.

Small bikes just happened to get caught up in the ban. They have since lifted the ban on bikes specifically.

It's congress' job to create laws concerning trade. That's what they do.
 
I understand that you are not the one who put the law into effect and im not ranting or mad at you .. BUT!!... people have lived for hundreds of years with lead in there ****.. me being one of them .. Im not dead yet........... and further more if someone buys a motorcycle to ride .... the last thing on there mind should be lead in the paint.. WTF!! heck i dont remember a single time when i was a kid that i thought it would be fun to go chew on the frame of my bike... even when i did wreck pretty bad. (heck i even bit it pretty hard)< a little pun intended) i still didnt get lead poisoning..


I did get a broken arm though!!!! ..



I want to thank everyone who helped get the bikes back on the showroom floor!!! ..

this is not a jab at you but just in general...

how many kids that are mentally and physically able to ride a motorcycle are going to chew on it? If these bikes are made from parts that contain lead, what about "all" other bikes, even for adults? Is that any different? I can understand banning toys and cribs that have lead based paint on them because small children handle them, chew on them, and put their hands in their mouths.

Also, "just happen to get caught up in the ban" is a huge oversight when it doesn't affect your pocketbook as a dealer or manufacturer. All sides of an issue need to be addressed. This accidental oversight may cost people their jobs, careers, and then further feeding the foreclosure or unemployment epidemic.

The Ban is not lifted. They have exempted the bikes from enforcement for 1 year. In that time they hope to have new legislation that will not include the bikes. As of right now there is no new legislation. In about 10 months if nothing is done small bikes will be banned again.
