The clerk at the convenience store asks for your ID too, and his/her job is far less important than that of a LEO.

Ah, the PC ****-with factor, but at least it's only asked for when attempting to complete a transaction that requires only the information printed on the ID, not something they have to run through their data banks.

These are fun to ask if you get pulled over too.

But safer to ask in court.

That said, I have always given my ID to any officer that asks for it because I, amazingly, have nothing to hide. It's just a faster way to get on with life. But there have been times when backstage "security" (i.e. uniformed off duty cops) at events demand ID from crew every time they walk through the "checkpoint" (i.e. where he gets to sit for his workday that is a fraction of that of the average crew member who has likely been there for 8-12 hours already), regardless of the fact that we all sport the proper ALL ACCESS credential that is specifically listed in full color at the very top of his checklist. That fûcker gets to chase my ass down every time. No me, no show. One of us has the more important job by the time his 'shift' starts, and it ain't him. But regular, on duty, police officers of any flavor get my respect and my info so we can just move on.

As I understand it, probable cause applies in the situation where a cop seeks to arrest, search or seize property. Asking for an ID is not, in my mind, a search...and James was well within his rights to deny that. I don’t see probable cause as being the issue here. I would have complied to save time and avoid hassle. That is all.

I'm guessing they could've been super strict and cited you for a class 2 misdemeanor? Technically you were not 'operating a motor vehicle' but logic would assume someone did for the vehicle to get there.

When am I required to give my name or provide identification to a police officer?

Unlike some states, North Carolina has no “stop and identify” statute. This means that, as a general rule, a person who is stopped by police in North Carolina is NOT required to provide his or her name or produce identification. However, pursuant to NCGS § 20-29, a driver of a motor vehicle IS required to produce a license upon the request of an officer. Therefore, unless you are stopped while operating a motor vehicle, you have no legal obligation to give a police officer your name or any identification when asked.

What happens if I refuse to provide my name or identification to a police officer?

Under NCGS § 20-29, it is a Class 2 misdemeanor for the driver of a motor vehicle to fail to produce a license or other valid identification upon the request of a police officer. You may also be charged with Resist, Delay, or Obstruct a Public Officer pursuant to NCGS § 14-223.

As discussed above, if you are not operating a motor vehicle, it is your right to politely refuse to give your name or identification to police officer when requested. Unfortunately, in our experience, some police officers in Wake County still falsely believe a person must provide identification upon request. Therefore, even though you have the right to refuse to identify yourself when stopped by the police, there’s still a chance you could be wrongly charged with Resist, Delay, or Obstruct a Public Officer (RDO) in the Raleigh area for refusing. Should this happen, an aggressive and knowledgeable criminal defense lawyer, like our attorneys at The Law Offices of Wiley Nickel, can show in court that simply refusing to identify yourself to a police officer (as is your legal right) cannot support a North Carolina resisting arrest (RDO) charge

When they initiated contact, I was not operating a motor vehicle.... Also they also answered the "am I breaking the law" with a "no".... so that's the end of that.

I was also surprised to learn the 24 states (per wiki) do have stop and identify laws (NC not being one of them) requiring an individual to show ID if they are suspected of a crime...which in your case, they said 'no' so even if it was in one of these 24 states then you wouldn't then have to show ID?

They likely wouldn't be asking fo an ID if they weren't suspecting you of a crime. But yes, ALWAYS ask when they're wanting ID: "Am I suspected of committing a crime". If the answer is no, then you are volunteering that ID. They can also lie to you and tell you that if you don't give them an ID you're going to jail...

This is why I typically only sell or give away stuff here on MUD unless I'm donating it. I bet I'd have less trouble if I put a price on it. Why do people getting free things always want you to jump through hoops to accommodate them? I can obviously not make it any more fair or a better deal than free.

Been trying to get the '96 LX into Costco for a tire rotation for three days. I tried to coordinate with the new tires for the Tacoma - not a good plan. Anyhoo - got it in today. Just got the call:

"Sir, we are sorry but your security key for your lug nuts has broken and your lug nuts will not come off. It looks like it is old. You should take it into Lexus to get it fixed."

Now . . . I don't like these security lug things, but given my son parts brand new 33" K02's outdoors at a college for extended periods, I was like "Maybe we should just leave those on." WRONG

Anyhoo . . . looks like they don't own any thing at Costco that can take these things off. You would THINK that they would have something like this:

Take a socket. If it is the toyota one a 19mm will fit. Hammer it in and get it out with the air gun. I had the same problem on the 80.
