only thing to make it right would be tlc finding another tailgate in like condition to settle the ebay issue. there would still be the suspicion over the original tailgate, but, at least they could say they made good on the deal.

Based on the information posted in both threads, I agree.
 
Orange- I'm not saying anything negative, as I'm not the one involved. But just check out the threads, and do the research. I think 1ton (as rightful winner of the auction) deserves to have the tailgate.

"Thru some act of luck" come on.....Not cool! TLC seems like a first class shop, but its kinda odd that the tailgate went missing, and sure enough 65' has it now! Lets take a dose of reality here....sure the 'Almighty dollar" talks in all business deals. That being said, the tailgate should've never been presented to '65 as being up for grabs, or even for sale! TLC should have told him that it was on eBay, and that the auction should have been made known to anyone that was looking at the bed.

maybe it was'nt presented to mike as being "up for grabs". maybe he was unaware of the situation until it was too late?!
notice how he has'nt replied. maybe that's because they're trying to work things out amongst themselves?!

either way, crappy situation for everybody involved! :mad:
 
OK..... I am now aware of the whole situation here, and will do whatever is required to set it straight. Here is the story......
First off, sold by me personally, not TLC. TLC no longer sells used parts and when I build ICON's or high customs, I try to sell off all the usable parts we do not use when we first process the vehicle (and when the client does not want any of it).
The bed sold and so did the tailgate, to two different buyers. The bed was shipped first, and when Gary (who assists me in shipping) looked in the staging area in our side parking lot for the tailgate to ship, other parts department employees said they thought they had seen it but noone knew where it was. I ended up with Gary in my office saying it has dissappeared and noone was sure what happened. Speculations about the scrap guy getting it or it getting stolen, but all speculation.
Now that I was made aware of the situation, I bitched about this reflecting poorly on TLC, and we needed to take care of the guy who bought the tailgate. So I extended a refund or discount down to cost on a new TLC reproduction tailgate (and almost the last one I have!). We appologized, explained the situation and proposed this solution which was excepted by the buyer.
Then the bed buyer contacted us to say that he received the bed, was happy wth conditon and the bonus fact that there was a tailgate with chains and hinges still attached! Mystery solved: someone here screwed up by not removing it prior to shipment. We had already reached a solution with the tailgate buyer, did not want to reopen that can of worms, nor did the bed buyer want to ship the tailgate back. So, we agreed to sell it to him. At that point it seemed everyone was happy.
Now the tailgate buyer says (after we shipped him the new tailgate) deal is off, and he wants what is rightfully his. A little late for this decision perhaps, but the fact is he is right. I, Jonathan Ward, TLC, or whatever you want to call me at this point will do whatever either parties involved want me to do. This has turned into a hugh pile of negative energy and hassle for everyone. I would like to get the bed buyer to let go of the tailgate which is not rightfully his. I will pay him to ship to its rightful owner, and refund him for the payment made to us for it. In turn, I will take back the new tailgate, or sell it to the bed guy, or whatever. I just do not want this to tarnish my reputation when all we were trying to do was make everyone happy and get these parts out to the community and in use. Hopefully there are enough of you out there who know me better than that. Email me and lets get this handled. Thanks- Jonathan Ward

Jonathan is a VERY stand up guy (Mark is no slouch either), and even though I consider myself his friend, I was a customer first. I'm just bummed this got dragged out into the public when it sounds like all parties were satisfied at one point.



hopefully this can all get squashed for good and no-one gets "burned" over a simple mistake.

I have not posted up until now hoping this could get resolved and at the request of Gary @ TLC. But now I must, I will NOT BE MADE THE BAD GUY HERE.
You all want the truth, so here it is. I won the bed on EBAY, that is true, but it was not shipped it was picked up by a cruiser head from L.A who was heading up to were I live. He showed up at TLC on Friday to pickup the bed and the two guys working in the shop slid the bed out on its side to his trailer, "thus scratching the crap out of a great bed" and would not help him load it the way he wanted, saying we did our job.
When he got to my house I discovered the tailgate was still attached to the bed.
Gary From TLC had called my wifes work number on SAT and left a message to call them knowing the tailgate was still attached to the bed. I called and talked to GARY on Monday about how the bed was handled (slid on it side) and that I had The Tailgate. I do not know if Jonathan knew at this point where the tailgate was, but GARY did!.
WHEN i talked to him it was decided that it would be too much hassle to send it back and all they wanted was to be paid for it, now knowing my bed was scratched. I paid for it as requested, believing they would take care of the buyer like GARY stated. Which they did.
This was handled bad from the start, from scratching my bed to not helping load it, to shipping the tailgate with the bed and trying to cover it all up.
I have done nothing wrong and let this B.S. thread continue until now. I have stated the truth, now its over.

well we loaded it for him into a small trailer. Not sure how else you thought we could have packed it, we did our best. Two guys helped him at his deirection. He showed up with no tie downs, straps or materials...

Really if you loaded it for him HOW DID YOU NOT SEE THE TAILGATE. when it got here it was on top of the small trailer resting on 2x4's strapped down.
funny thats the only thing you commented on.
 
Mike, sorry about the bad experience, but it doesn't sound like anyone tried to cheat here. A mistake (or a couple) were made and s*** happened...be glad you got a nice bed even with scratches- you got one with matching color? or were you going to paint it to match? do you feel like you got a bad deal?

I didn't get the impression that you were a bad guy at all.


I'm just trying to give some outside perspective here, if the parties involved wish, tell me and I'll keep it to myself- more than anything, it seems this could've been cleared up with a couple of phone calls and a little forgiveness for making a mistake.


remember that we all are here on mud to support each other in our love for landcruisers.
 
1. I am glad this is in the open now. For everyone's sake.

2. As I said, there was no theft. Just an honest mistake. You can draw your own conclusions about how things were handled after that.

3. Mike, FWIW, I think the choice that would give everyone the most credibility here would be for you to pay the difference and take the panamanian gate at TLC's cost[ I will bring it up to Sacto at Rubithon time and save you shipping] and you send the other one [taking Jonathan up on his offer to cover shipping] on to 1 ton toy. Then Jonathan will have honored his commitment and you will have an absolutely clear conscience and a smokin deal on a BRAND NEW tailgate. I was by there shop last month and saw the panamanian gates, and they are AWESOME! I would have bought one, but my lwb is too much of a beater to have anything that nice on it.

no, bed guy owns the bed, has the tailgate. Tailgate guy has a repro tailgate but does not want it anymore. Bed guy should work it out with tailgate guy, and let me know what I need to do so we can move on. BTW, with 22 employees, do you think everyone here would know and be involved? The guys who were kind enoughh to load the ben had no idea if a tailgate should have been on it or not. They were helping. I did not bother to comment on the bed buyers concern that the 42 year old used bed he bought had scratches....
 
I know that a 40 year old bed will have scratches, but when your employees slide it out of your shop on its side, I have a problem with that.

I have no problem giving up the tailgate. I do not want to be responsible to ship it as I am not in the shipping business. If TLC wants to ship me a crate to put the tailgate in and pay for it's return I will ship it back to them only . I do want a tailgate with the hinges and chains. If they have one that has all the accompanying hardware, I would accept that. Gary should have my cell# as I called him numerous times.
 
This is what I would like to happen.

65-FJ45: please send the tailgate, latches, catches, hinges and chains to TLC. These items were all part of the eBay auction.

JONATHAN, GARY @TLC: please send me what 65-FJ45 sends you, IF IT IS NOT DAMAGED. Credit my paypal account the difference which I paid you for the repro. Also, please send a UPS/fedex pick-up for the tailgate you sent me. I should not have to pay for return shipping. Your guys tried to cover this mess up and you could have avoided it. As the owner leader of TLC, you have to take responsibility for your 22 employees. I, too, run a business and I take responsibility for my employees. Take it out of everyones check. This is the only way people will pay attention. GARY should have my cell# b/c he has called me, too. As an alternative, if you, TLC, have an ORIGINAL tailgate and hardware in like condition as the blue one, let me know. This could save some time, headaches for all, and shipping costs for you.

THe point is 65-FJ45 nor I should pay anything more.

1 tontoy, why not keep the new tailgate and have TLC refund the difference you paid for the new tailgate vs ebay tailgate. Saves all the shipping things here and there and you have a brand new ready for paint tailgate, Just my 2 cents

i think 1tontoy wants the original tailgate since it has the hinges, latches and chains......

i also think that he already agreed to buy the repro tailgate and now he wants to back out of a deal he made......

i also think that the title of this thread should be changed because nothing here was "STOLEN!!!!!!!"......

i also think that i'm damn glad that i'm not in anybody's shoes here. this is a mess for everybody involved and it's a loose, loose, loose situation. so you just need to figure ut how to minimize your losses and move on.

please don't get me wrong 1tontoy, i do not think that you are responsible for this mess at all nor that you should have to settle for the repro tail gate because somebody at TLC screwed up.

hopefully jonathan has another original tailgate and hardware dor you and you guys can work something out along those lines.


fwiw, i think i have a set of hinges, latches and chains on my old beat up "hang it on the wall" tailgate.............
