You probably need to realign or adjust the swing arm then because the slam latch design is the easiest system to operate when installed correctly. Here's some videos that show the ease of operation and the alignment process.

Correct, fortunately as @tbisaacs pointed out, it is an easy part to swap out on the tire carrier. Every year we have 2-3 people miss that step in the instructions and have this same failure. For anyone who comes across this and has our tire carrier, make sure you have a stack up of 3 pieces...

Looks like you do not have the stiffener plate installed which is very crucial for the strength on that tire riser. Send us an email and we can let you know how to go about replacing it.
