I checked my transmission fluis today on my 4 speed FJ40 using the top side plug and about 8 oz. of oil came out before I could get the darn bolt back in. Was it over serviced? Is this possible? Does it matter which gear you have it in when you check it? Thanks

Sometimes the transmission will pump to the transfer and vice versa. That is what John is referring to.

get a couple of fittings that'l fit into the fill holes on the Tcase and transmission, and run a hose between them...
check for water
I thought the same thing on an old 3 spd that I removed and fed to my dogs. Instead of being extremely overfull, it was half full of water. The water layers under the oil, so when you check the level from the fill plug, only oil will come out. I doubt this is your case though. That tranny did not shift too great, probably because it had more water than 90W in it.

That is a stupid fix!
Why not replace the seal for a whole $10 vs. rigging some oild return line that will leak even more fluid...
I thought it was a joke, not a fix...
