Is the frame bent?
 
I believe a new oem bumper painted and installed equals the cost of some aftermarket rear bumpers.
 
Was wondering if I need to claim insurance or get a metal bumper 😮‍💨
Yes.

Seriously doubt it. The structural "bumper" under the fascia isn't a bumper in the traditional sense. It is actually a crossmember - and a stout one - as in 7mm wall thickness tube with substantial gussets where it joins the frame members. And if anyone wonders why our rigs tow so well, look at the reinforcing gussets for the receiver hitch welded to that cross member. Nothing bolted in place - all full length MIG welds. I feel for any vehicle that rear ends our rigs.

If you got rear ended the other driver is a fault.* Claim their insurance monies and put it towards a bumper of your choice.

*and one of the few cases where one (who got hit) does not get hit with the claim.
 
Those types of scratches on the plastic bumper where the black plastic underneath shows through are the worst to try to touch up, since the edges of the scratches usually have deformed outward above the level of the paint. But touch up paint will still make it a lost less noticable.

I wouldn't claim insurance though... you'll get a ding on the carfax that will reduce the vehicle value more than the cost of the bumper. Unless you're going to keep the vehicle forever, then doesn't matter.

I had scratches on the bottom of my bumper from offroading, very visible. It was enough to push me to buy the E&E Offroad bumper from @turbo8. Being a low profile bumper that keeps most of the oem skin, though, it wouldn't get rid of the highest scratches you have there...
