It took me ten years to get to 90% with unemployability, I just kept filing and appealing. Several exams by psychologists didn’t produce a report that reflected me at all, they wouldn’t let me answer questions. I’d just start answering the question and they’d cut me off with another question, the whole exam was that way. Finally in the end I got someone that wanted to hear what I had to say, and her report did reflect how I was doing. It really is a flawed system, you have to be persistent.
 
Be careful who you get advice from online, warns the guy about to give advice. You can’t sue the VA over your rating. You can file a TORT claim for medical malpractice but you can’t sue them. Keep fighting and don’t let them win. Remember, they are incompetent! Took me 14 years. I waited another 5 to see the judge on TBI after that. Took her two years to issue the decision of REMANDED. Now mind you I have 5 TBIs. Skull fractures in two place and frontal lobe scaring. After 9 years and 4 deployments I got no medical retirement. The entire system is against you. I’m still not rated for two tropical illnesses, dispute those being an automatic 0% if you survive. CFR 38 is available online for everyone.
I am not going down that road but apparently the guy has received some huge settlement :meh:

Anyway, update, I just got bumped up to 30% and that adds a bit since it allows an increase for a dependent. My tinnitus is still in the appeals process and the decision has not been made on my ulcerated scar yet.
 
And just bumped to 40% but the tinnitus remains on appeal.

I really did not expect this sort of success when I started this journey.

Just received a notice that does not specifically say the appeal was approved but says it is continued which leads me to believe the appeal reversed their decision.

So there we have it. Hope I am done. I am satisfied with my results and hope I do not have to revist this due to any reversals or ailments that may begin later in life under the PACT Act.

If anyone has any questions about the process you can PM me. I know I made some mistakes and really had to muddle my way through but did get better results than I expected.

So, depending on what you’re rated for expect them to ask again. Don’t dismiss any reassessments as they are chances to increase your rating or for VA to say you’re all better and take it away. Make sure you double down on how it effects your ability to
