Got screwed, no longer own a Toyota

So I had finally gotten all my parts together lift lockers, the whole schmoe, then through my own stupidity (and some DMV confusion on paid tickets) I got my truck impounded last week. Didnt have two drivers but I have AAA so I figured free tow, just hook it up and drag it to my house. It fell off the tow truck and drove down a steep incline backwards bashing through trees and bashing into a giant rock. It is totalled. The tow companies insurance company decided to tell me that I'd only get $200 for the vehicle, and the tow company is telling me that they feel bad so theyll give me a heep charokee. Its an 86 in great shape, but hell, what am I supposed to do with this fine American vehicle? Sucks :mad:
 
Whao.... the tow truck let your truck fall off and roll down a hill and they want to give you $200?

Did you explain to them that this is America? And when you screw up like that in America... you get sued? I'd go talk to your insurance people and get some advice.

Is your Runner unrepairable totalled, or just insurance-totalled?
 
do you have receipts for the upgrades? You will need all that to declare a value over the book value.

When done, buy the totaled vehicle back from the ins. co. and sell me the lockers cheap.

Insurance companies pay by recent sales comparative price, have them show you how they determined the value? Have you priced a good running early straight axle truck lately? There are two straight axle 4runners (85’s) on Auto Trader, only one with a price $6,398!

NADA lists the average retail value at $3300, I doubt that an ‘86 heep is worth anywhere near that! Check all of the car selling sites, ebay history, etc to get an idea of it’s value. I bet you find that the truck that they dropped is going to cost much more than $200 to replace.

If the frame isn't bent up I would make a deal where they cut you a check and you keep the truck. Even if you don’t want to build it, there are plenty that will buy it to make buggies, formula toys, etc. They aren’t making anymore straight axle trucks, they are becoming rare, so they have value!
 
The ONLY way to deal with insurance companies and the like is to sue. No ifs and buts, get a lawyer onto them right away.

When my wife got smashed in a parking lot by a student driver I immediately took pictures and sent them to the insurance company with an ultimatum to fess up or be sued. In the past I've had my share of aggravating insurace companies that minimize the loss and try to prove you are responsible. It's how insurance companies work: disclaim responsiblity to pay as little as possible!

Take tons of pictures and contact a lawyer right away. If you have no response, register a lawsuit with the local court and send them a copy by bailiff. It's the only way to get results with these sharks.
 
wow. thats about all i can say. besides.... "SUE! SUE lawer SUE!" quote from Brian Regan. i'd be frikin pissed if it were me and i'd prolly sue the pants off AAA or whoever towed it.
 
My 87 4runner has a nada book value of over 4000 bucks. I would give them an opportunity to compensate you, by this I mean see a lawyer and have them draft a letter of intent. Basically stating if you do not compensate my client for his loss within a reasonable amount ie 4000 bucks etc; then you will be sued for a reasonble replacement cost + attorney fees+ auto rental costs.

A half-decent bottom-feeder can draft you a letter for a reasonable cost, trust me it WILL GET THIER ATTENTION. You will be getting a phone call and a check promptly. good luck and sorry for your loss.
 
Well, the truck was a trashed rustbucket, and they are letting me keep the vehicle, comping me $300 for the tools that flew out of the truck and were either lost or destroyed, and giving me a 4.0l cherokee so I guess it's ok. Its pretty much only body damage so it looks like this truck is going to be turned into a full out rockcrawler and not the weekend destroyer I had planned on. I don't want to sue them because I may need them again in the future and they have done me some favors before on tow bills and such.

i'd say that looks pretty good considering what happened. where is evergreen exactly? i've got some family in the applewood area, or somewhere close to that. really sucks but hey, now you get a free heep for daily use (when it's running and drivable) and an awsome crawler for whenever.

Hey! It's not so bad! Far from being undriveable... Look at it this way: at least you won't be shy trying some wild stuff now :)

you are an idiot if you dont sue them! s*** man they have insurance so it wont hurt them to bad they f-ed up and now they should own up to it. if they cant secure a vehicle properly while towing they diserve to be sued
