Are New 315 Toyo Open Country MT's OK for the Malahat?

Never been stopped for the M+S tires I have run in the past, but it has always been M+S or snow flake, or the 3 peaks to be legal. They may be changing it now, I don't know, but I do know from my sister who is the head accountant at Toyo Tire Canada and she says they are working on getting the MT snowflake or 3 peak rated, probably because all the confusion about it, or the fact they will make it mandatory to run more then just the M+S in the future. I have run the Toyo MT for the past few years and it handles pretty good on icy roads, but not as good as dedicated winter tire.

With the mess that is ICBC, it might end up like this distracted driving phone mess so I’d err on the side of caution. That being said, unless a person is stopped by a CVSE officer probably be okay.
 
From a bunch of reading I did last year, I was under the same impression as @burnz. I wouldn't want anything less in snow/ice anyhow; even if it's just a few days a year.

Opinion on whether wanting to run a tire with a snowflake symbol aside (I agree it's a good idea) it literally says on the ministry of transports website it is not necessary to have the snowflake symbol to be considered a winter tire, for use on these designated roads. I'm not sure what other reading other than the ministry's own website would be valid, but I would certainly we open to reading other information.
 
Your probably fine if your not speeding or have your cell phone within 15 feet of you.

The last two weekends they have had “cops” (a better term would be traffic wardens as they are just icbc minions that I’m pretty sure would burry their head in the sand if a real crime was being committed) hiding in the bushes handing out vehicle impounds to speeders. The wife had to go pick up her friend last weekend. 7 day impound for going 110 in 80 zone on the strait where they always sit just before the single lane hill bit.

i have been threw the Malahat winter tire road block they hold at the intersection by my place for several years now, pain in the arse. i always run decent all season tires though, never had an issue. Funny I never once have been stopped for a tire check on the real passes in the interior.

It is very good. Not only does she do my taxes for me, friends and family of Toyo employees get discount on Toyo's and are the only reason I am running those expensive tires! ;)
