In the 14 years of living at my home, which is close to downtown Victoria ( i.e. drug trade), various items have been stolen my vehicles (small items, always the parking change) which are parked 50’ from the street. In most cases the thefts have been minor, but several years ago a large amount of silver jewelry was stolen from my wife’s car, the night before she was going to a craft fair.
The jewellery was stolen by a causal worker employed by a carpenter doing some work on the front stairs. I gave the police the suspect’s name and grandmother’s address, where he was staying at in Victoria to the police.

Nothing recovered - never heard back from the police.

In June 2012 my detached carport/garage and vehicles were broken into in the middle of the night. My titanium mountain bike (had it 20-years), various camping equipment, jewellery making tools, automotive tools, cordless drills and related equipment were stolen in the middle of the night. Total value of the theft was just under $9,000 (largest portion being the bike) which I got about $ 0.50 on the dollar. The police came and took finger prints, took written statements, but I now believe the police exercise is go through the motions, get the victim (me) a case number so I can file an insurance claim. I just renewed house insurance and lost my 5-years claims free discount, so my house insurance premium went up.

Nothing recovered - never heard back from the police.

It has become more than obvious that I can’t depend on the police. I expected the thieves would return. Over the summer I had silent alarms installed in the detached carport/garages, which would buzz in the house. An audible alarm in the carport would likely scare him off (with what he had had in his pockets) but he would not be caught allowing him to continue his nighttime hobby. My objective was to get the scumbag in jail.

Last Tuesday night I came in from the garage at about 8:00 PM and set the alarm. At 2:30 AM the alarm went off and I got partially dressed and looked out the kitchen window and saw all the motion lights were on along the driveway (two pairs) – very strange - I thought it must be an animal that tripped the alarm in the carport??. So I walked up the driveway to investigate (bear spray in my pocket) expecting maybe a raccoon? -- but saw nothing. Then I saw my wife’s car door was open, and in the dim light I could not see anything so I thought I had been too late and the scumbag had fled.

I walked up to have a look, but in the low light and a dark interior I could not make out anything. I was two feet from the open car door and made out a figure with a dark hoodie over his head rifling through the glove box. I was right next to him and realized the scumbag is still in the car!!!! I yarded the scumbag out the car and tore his jacket off (good for dog tracking). He ran down the driveway and so we scuffled and I threw him over a two foot high flower pot which he broke. I chased him across the street and got him again and during the melee I discharged my bear spray at very close range, but I got back spray in my face and he bolted from my grasp. I had to head home to wash out my eyes. Lesson learned - aiming bear spray with those clumsy (bottom heavy) bottles with that cheap Mickey Mouse trigger set-up in close quarters is not advised.

My wife called the police and the Oak Bay, Saanich and Victoria police arrived with a dog team and with the scent from the jacket, they went looking for the intruder. Although, the police dog had his scent, the dog lost it for a while, but latter the intruder was picked up and now sits in the Saanich jail cell. The scumbag is well known to police and sitting in jail as “the investigation continues”.

Upon reflection when I walked up the garage I should have assumed someone was still in the garage, but the driveway lights were shining in my eyes which make it impossible to see in the carport. While I was getting my medical check the police took my wife’s car for fingerprinting. We picked the car up yesterday after they had checked for prints.

I am hoping now they can connect this scumbag to the theft in June so I at least I know I am dealing with one scumbag rather than multiple scumbags.

Planning has commenced for Phase II of my Homeland Security Plan.
 
Good to hear Glenn. Do you have any stairs around that a douchebag could "fall" down, which would explain all the bruising on the perp the next time the police show up after you catch them.

As for insurance. I've had good dealings with BCAA. When my garage was broken (twice) into when I lived in south Burnaby (hooker/drug dealer central), they replaced all my items no questions asked. I did have to go and re-purchase on my dime, but was reimbursed in full afterwards.
 
Glad you caught him Bill and the police latter caught up with him. Just wish the police dog had a chance to set his teeth into him. Now lets hope he actually gets convicted. Not that it is much of a punishment. I was once told by a cop that some of these guys just consider getting caught every once in a while a part of their trade. They get maybe 3 - 12 months in jail with full meals and rec activities. Most of the time they keep the proceeds of their crimes because police are unable to discover where those proceeds are hidden. For career criminals like this, it would be nice to see forced labor as part of their sentencing. At least society will get some pay back from their offenses and it might act as a deterrent. The minimum security prisons they get sent to certainly isn't any deterrent.
 
Good for you Glenn! congratulations, sadly, he'll get community hours or some other BS minor sentence. Next time, make sure he trips and hits his head many times as he is running away..... over and over again..... criminals are usually on drugs and have many accidents happen to them under the influence ;)
 
nice work glen to bad about the bear spray part. years ago i was at a party and the girl who lived downstairs was yelling i looked out the kitchen window and a guy was trying to steal a bicyle pushing her out the door .i jumped out the window landing on top of him and the fight was on. he gets off,and he was trying to charge me with assault but later dropped ,all i can say is thank god that bike caused all his injuries.

Problem is both at the cop and judicial level. Courts wont do anything to these guys so the cops are less interested.

The wife is a VPD PC with 12 years in- on the second day back from her mat leave she was savagely beaten by an addict while responding to a B&E call at an elderly lady's home in SE Vancouver. Astonishingly, she was able to subdue the perp until help arrived but was beaten terribly and her partner, also female, was slashed repeatedly, head and throat, with a piece of glass from the little old lady's screen door.

Moral is, the perp was out of jail the next day with a slap on the wrist charge, the crown wanted attempted murder due to the glass slashing and grabbing my wife's sidearm. She got beaten so badly because she had to use both hands to hold the pistol in the holster while he punched her in the face with his free hand. Judge let him walk. Couldnt even compel him to take an HIV test since his blood was mixed with the wife's. (he refused) Wouldn't want to trample on his rights, right?

I share your frustration, it is only likely to get worse.

Yeah. The cops are not the answer Glenn. A judicial system with some balls and a re adjustment of the attitudes towards sentencing and punishment might help. I like your style. Get a clear understanding of your rights. Make sure the individual is across the threshold before you beat him.

In the 5 times I have been robbed - the only time the scumbag got caught is when I intervened.
 
Being robbed of hard earned property sucks, seems like everybody gets a turn somehow. Be carefull though glenn. Two years back while visiting the in laws in prince george, the alarm of one of their neighbours went of around 10 at night. Two of us got outside and saw some kids run of. We decided to follow and phone 911 in the meantime. Stayed on the phone all the time. Followed the guys trough the neighbourhood and guided police to them. When they got arrested police found a nasty big hunting knife on one of them, we were right there. Last year my wife went for judge duty in westminister in a case very similar. Boy got robbed a block from his house. Father chased the kid, kid was stoned pulled a knife and killed the father. Kid was found guilty for murder but because he was underage and stoned at the time, could not remember anything blablabla, got of with minor jail time. Needles to say life is worth more than property what can be replaced. Just my 2 cents. Ronald.

This is just a brief summary but:

You may use force to remove someone from your property provided it was necessary and reasonable given the circumstances. As to exactly what this means comes down to the common belief of the "reasonable person", aka the average Canadian with average intelligence, etc. For example, if someone barges into your house it would be reasonable to most that you could push/drag them out and possibly detain for police. The law has recently changed allowing citizens who own or have lawful possession of property to legally arrest anyone they find committing a criminal offence on or in relation to that property. In the past, citizens had to find the accused in the act of committing the offence however it seems now that even if they are seen walking away and there are reasonable grounds to believe they committed an offence, they can be arrested by a citizen. Police do need to be contacted right away following this.

It really comes down to common sense and what amount of force is reasonable. The best is to utilize the minimum amount of force to control the accused while avoiding injury to yourself.

My internet is acting up but I can post some links to this for further clarification and "light" reading when I have a sec. :D

I can also say I have an intimate and equally frustrated view of our judicial system.

Dogs are a pretty good deterrent and line of protection. Much better than an alarm. When we first came here, B&Es were a real problem and there were only 2 or 3 homes with dogs on the block. Now more than half of the homes have one or more dogs. The last 4-5 years there has been no B&Es that I know of. Our female GR has now chased 3 guys out of our back yard at night. Maybe more there have been more that i just have not seen. Almost every night she goes out to do battle with any intruder into her yard: mostly possum or raccoons that frequent the compost pile. It can be a bit annoying but she does take care of the two legged intruders too.
 
I know we need to be careful about reasonable force in stopping a felony (Fleeing Felon law?) but filling an ass full of 12 gauge buck shot would just feel so good! :grinpimp:

Sorry, a little red under the collar tonight, just got back from PG....

Yeah, theft just boils me, so it's probably a good thing I don't own a gun.
