Two things:
1. Only repairs that get reported ever make it to CarFax - not every place reports repairs
2. Whenever buying used, regardless of dealer or private party - ALWAYS get a pre-purchase inspection. This will alert you to anything that may be unreported or wrong with the vehicle. In your case, I almost guarantee frame damage would have been discovered.
I am not sure what recourse you have, but you are in a difficult situation. Maybe you can sue the selling dealer for non disclosure of prior accident?
Good luck!
Wow, I really feel for you. This is a horrible situation. I would try going after the dealer, and if that accident was reported to insurance and it still did not show up on carfax you may have a case. They have a certain type of a guarantee. I would look into that, and what another poster said... go after the dealership for withholding information. Please keep us posted on how this prowesses for you.
Do you have anything in writing from the dealer? Even if not, does a local news channel have one of those helper/ investigators? You could also put together a non slanderous social media campaign.
Yes it's a terrible situation you're in but I definitely think you have legal ground to stand on. Unfortunately, it's like most legal matters in this country, it all depends on how good your lawyer is!
It looks like the Carfax guarantee only applies to branded titles. I'm not sure you really have any reason to go after Carfax unless the vehicle was previously given a branded (salvage) title.
Sorry, I've been taken a couple times, even with PPIs. The insurance claim would have required a police report - try to get that. Find out from the PO who repaired it and try to correlate their work with what you are seeing now. I think that would give an attorney some leverage.
I hate it when people say this to me (invariably someone with millions in the bank), but it's just money.
First of all I feel very sorry for you and hope you will come whole on this !!
It would drive me crazy to be in the middle of as tory like that!
How long before you bought the vehicle did the accident happen? - it matters for Carfax report as it takes some time for it to show up.
I would make a contact with Carfax and at least let them know what the situation is and see how they respond to it.
Also when it comes to your engine issue I don't think anything can be proven as part of the after the accident repair and it will be treated as potential "story", but I would try to get your car insurance involved and see if there is any coverage existing in your policy that could help you...
As much as this is hard to deal with, try to keep a healthy perspective on what is really important in life and that there are far more painful things that could happen.
It is a financial loss, but nothing that cannot be fixed or replaced...
Thanks for posting. Major bummer, but lessons shared are really valuable to others. I have no idea what to do next, but I did wonder if the frame damage is repairable? If so, with that and a new engine you could at least consider trading it in with a clear conscience?
There is frame damage, but are there safety concerns or does it ride poorly? If ok, just keep it and enjoy a new engine. If safety issue then burn it and collect the insurance. Just kidding, but not really.
