Wrecked Debi's new car yesterday

Well technically I didn't but a 80+ year old man driving a Lincoln did. He told the officer, a friend of mine, he "must have fallen asleep" :mad:.
I was stopped at a red light on the highway with 3 other cars behind us (Holley & I) when this the gentleman "fell asleep" and slammed into the back of an GMC pickup with his Lincoln. I heard the crash and mashed the throttle to get into the left turn lane and out of the way.... probably saved a little damage but not enough to avoid it all together. All in all the Lincoln and the GMC are totaled, the brand new Nissan Mirano (less then 4K miles) had close $7K damage, the Grand Prix that was behind us may total because of it's age and mileage and we need a new bumper cover, deck lid and a couple hours of pull time for the rear body panel to get straightened back out.
Holley was scared, bad! She's a little sore but okay and didn't make up dreaming about it. One lady went with EMS to the hospital with back and knee pain. The old man was of course fine since slept through the whole damn thing.
He has had multiple accidents this year alone and the PD kept his license to submit for a driver's license review :clap:.
I thank God it wasn't any worse and that I didn't drive the Dodge yesterday as the Grand Prix would surely have gone under it :eek:.

All you old farts need to get your naps before you drive anywhere.... not while your driving :flipoff2:.
 
Glad you & the little one are OK......

I have said for a long time, at 70+ (or some set age) you need to take another driving test for ability & reaction........

I know this would make the older folks very unhappy but how many time have I been run off the road/merged into, or just lost easter eggs in traffic & then folks get into accidents because of them.


Heck when I get old.....one of them power chairs is how I'm rolling:idea:
 
I am glad that you and Holly are okay! Pretty scary, especially when your kids are with you. And whiplash sucks!

I was rear ended twice in six months. It sucked both times, but as a mother it was harder emotionally when my kids were with me.

The first time I was by myself in our FJ62 when a semi running interstate speeds punted a Ford Explorer into my truck. I was the last vehicle in in a very BIG and highly visible line of stopped traffic waiting for an accident. Shook me up pretty good. The ambulance ride was a new one. I learned that the paramedics that work the life flights are much better at putting IVs or saline blocks in than any nurse at the hospital. He got it first try and we were bouncing around like crazy. Nurses at the hospitals try three or four times, then give up and go get another nurse, who then tries three or four times. :bang: I also learned that the emergency room is one of the most over priced services you can get at the hospital. I lost a very nice Land Cruiser because of it, plus I had to wait over a year to get the truck driver's insurance to pay. :bang::bang:

The next time I had all three kids with me in my 80. I stopped at a yield sign due to oncoming traffic. The truck behind me never stopped or looked until he had already hit me. After pulling completely off the road and shoulder into a driveway and verifying that my kiddos were okay, I got out ready to fight. The guy said he never saw me. I explained that a yield sign did not grant you right of way. You were still responsible for verifying that there was not vehicle traffic in your intended lane, which was the reason for my truck stopping there. Then I had to put it in simpler terms. "What were you thinking? There were cars coming. Did you expect me to either pull out in front of them or run into the side of them? I stopped for them." I said. The stock bumper on my 80 did not show any damage, but the front of his truck was pretty ugly from the impact. I check again with the kids to see if they were okay, and told the man to be more careful next time. When I got back into the truck I had to apolgize to the kids for losing my cool with the other driver.

I hope that everything works out for y'all. Be on the lookout for old people:steer:! or you might be doing this:bang: and this:wrench:. Fighting insurance companies is a pain.
 
Yea like you would know what it costs to fix a car...;)

Holley seems to be doing okay. She's talking about it and it still scares her, but so far no bad dreams about it :clap:

I got to spend most of yesterday on the phone with two different insurance companies :bang:.... What a PITA! I hung up on one chick when she starting yelling at me so I called back and spoke to her supervisor and started yelling at her..... Seemed fair at the time.

So far the gentleman's insurance has not accepted liability and they tried to talk me out of a rental car while mine is in the shop.... That didn't go well either . I suggested they get it figured out very, very soon and ended the conversation. They also would not disclose the amount of coverage he carried.... I didn't figure they would but it could be fight if his policy isn't enough to cover all the vehicles involved :mad:. They kept trying to get me to tell them Holley & I weren't insured. She got a little annoyed when I kept repeating "We refused treatment at the scene but will be going to our family doctor for an examination".... This went on for about 30 minutes :censor:. I take little pleasure in having to "haggle" with these jackels but I'm not closing any doors until I know everything will be taken care of.
 
My advice- get a rental car equivalant to what you have, file against your insurance company and let them & their lawyers subrogate against whoever.

They'll work harder for you as their insured than the other guys will as a claimant. To one company you are a customer to be taken care of, to the other you are and expense to be managed.

Since it's a new car, insist on OEM parts, repaired at the shop of your choice and when the repairs are complete have 2 independent appraisers give you appraisals based upon pre-accident value and post-accident value (they'll want to see the estimate) nad file for not only the cost of the appraisals but for the diminished value as well.

That will get you about as much compensation as you are enitiled to for the material damage. When you take delivery of the car and accept a check, you agreeing to a settlement, so be judicious.

You are also entitled to compensation for time, durress, etc. but you will most likely need an attorney to guide you through that. I'd probably consult with one now if you haven't.
