As long as it's not disabling any codes from the safety or smog system sensors (cat efficiency, O2 sensor, etc.) you should be fine in MA. I "know people" who ran cars with basic tunes for a while without any issues.

Great question – I’ve been curious if Lexus has a way to determine if the ECU has been flashed as well, but it have been unable to get an answer from anyone

It's not like a turbo vehicle that gets its ECU flash to push performance on an over stressed engine. If you are out of warranty, I would not worry about it. If you are in warranty, I do not think it is a big deal. Flashing this NA V8 is not likely to stress this engine anywhere near the point of failure.
If you're worried about the flash, I'd pay for a VF Tuner license and OBD2 dongle so you can load/unload the tune and replace with stock if you ever need to take the vehicle in for warranty service. You just need a Windows laptop to do that.
