I'm with hammer1- i've removed as many water and mud-trapping contraptions off my 62 as I find 'em. Flares are a legal issue in many areas though. Our OHV laws require tires to be inside fender wells, or use flares to cover. Not a problem with cops on the highways as much as the cops that patrol around OHV areas- those guys know 4x4s too well. 
it'll likely never be an issue for my 62. it's perfect on 33x10.5s for the expedition trips it is built for.
