My sister just bought a ’77 FJ40. She’s not that familiar with 40’s so she had me talk to the seller to make sure it was not going to be a piece of junk. The owner is an active member on mud, and I read his build thread, so when he told me it was good to get in and go as a DD, I was confident in recommending it to my sister.
They negotiate the price and next thing you know my sis is pumped up and buys a plane ticket to go pick it up and drive the 4 hour trip home. When she gets home, she calls and describes a problem she was having which sounds like a slipping clutch. So on Monday she takes it to the shop and the mechanics confirm what we expected. Clutch is shot.
I need to add here, that the owner did say to my sister when she was there to pick it up, that his mechanic told him the clutch might need replacing at some point. A fact he failed to mention to me when confirming that it would make a good DD.
So my question here is, what are my realistic options

- Negotiate for seller to replace the clutch, or at least half.
- Unwrap the whole deal giving the car back to seller for a refund including plane ticket.
- Buyer beware, you should have been more careful.
- Or somewhere in between.
