Interesting thing is, I heard an interview with an ethics prof. about this very thing about 2 months ago. He said that ethically, using WiFi (honestly) from an unsecure source wasn't that big of a deal. He related it more to picking up raido signals with a car raido...
That said, I've heard that people who use the iTrip with their iPods will put a bumper sticker with their radiio transmission signal on it so that other drivers can tune in and listen to what they are playing.

IMO give him a hefty fine and some community service hours... jail time would be insane for this unless he was stealing info or committing some other malicious act.
I think what the difference is that someone paid for the WiFi band width.

I'm dumbfounded at the number of people that don't know how to secure their wireless networks. Right after I got my wireless card for my laptop I went out on my deck and noticed that I was picking up 3 other networks from neighbors, only 1 of them secure.
it's kind of like leaving you car unlocked and the windows down in the mall parking lot. If you do not want anyone piggybacking your wi-fi signal, use the security key. hmmmm maybe that's why the network people call it a key

The problem is: DIS-honesty. The whole reason you have to lock your car in the first place.
I lived in a small town in Southeastern Kansas in the early 60's and NO ONE locked their cars, took their car keys out, or even locked their homes....there was no need to.

stealing is stealing no mater how you look at it, but since we do not live in a utopian world, I am going to lock my car and wi-fi network. When do you think ownership of the air we breath will be an issue?
