I was checking the gear oil levels in the transmission and transfer case. My transmission was overfilled in fact when I pulled the plug a quart erupted from the hole. After cleaning up the mess, I checked the transfer case it was about a quart low. When I first got the vehicle (2 years in Sept) the transfer case was about empty. I attributed this to the leaking front output shaft seal which I replaced. Currently there are no leaks coming from the transfer case.

My question: Can the fluid from the transfer case seep into the transmission? I can think of no other explanation.
 
Sounds like the seal between the trans and transfer case is leaking. they make a hose that goes from the fill plug of the trans to the fill plug go the transfer case just for that issue. It is a bandaid fix but will keep you on the road
