So coming back to close it up. Found the passenger side e-brake was hung up. Also found drivers side wheel bearing loose even though they were torqued, must not have been seated 100%. Oh well all is well again and didn't throw $ at good parts.

I have a similar issue with one of mine, but it was from dropping it when taking out of storage. The two things that I have found that make it actually latch is first I slam it down and also make sure the little rod that attaches to the handle that allows you to slide the seat is fully disengaged.
