Tube bender- Legal and Liability discussion
As per John's suggestions, we are starting a separate thread for legal and liability discussion of the club purchase of the tube bender. Please do not discuss the tube bender itself in this thread but refer back to the original thread: http://forum.ih8mud.com/va-dc-md-cap...osal-club.html

I have some lawyer friends who would be happy to help us but I need to know the current legal status of the CLCC. Are we a Non-Profit, LLC, Corp. or what? I know when Lance and Scott were in charge of the club that they were working on getting us recognized as a legal non-profit entity. Not sure if the paperwork was ever finished or not. But I seem to remember it was. If we don't know the current status we should get the club setup legally properly first, then we can address the bender much easier along with any other liability questions.

I don't think any of that was ever complete. If it was, there would be paper work that had to be filed every year and there would be insurance that had to be paid for.

I am pretty sure we are not either. We would have heard about it. It takes some time to do all that and we have not been too organized.

I think Ross Canup had been working with some of that paperwork before he turned the Treasurer duties over to me. And we all know how great I did.
Les might have some info in the stack of papers I gave him as the new Treasurer.

The pu$$ification of America
What ever happened to at your own risk!
I do not what to stand on a soap box ( i can't type) but this is what has happened to the world. everyone whats something for nothing. I do understand if there is grose negligence but if I do something stupid then I do something stupid I should pay not everyone/ anyone else. I've broken multiple bone and have had one surgery because of stupidity/ riding over my head on a motorcycle and i have probably left thousands of dollars on the table because of morale.
club liability may need to be looked into because we do not build teddy bears we build 4wheel drive off road vehicles in our own garage if only club members use it we take the responsibility onto ourselves.
I will step down now
Chris

I think even if you build teddy bears, you need some serious insurance... probably more than a 4x4 club would

Here is a copy of the club's bylaws. I have no idea where I got it from and the crossed out sections were there when I received it.

this is just from the outside looking in, but if you are worried about liability, it seems to me that tech days, trail repairs, and other "help" would be a higher risk than having a bender.
Slap a big ol sticker on there that says use at your own risk and call it good.

This thread has caused mental anguish ... you'll be hearing from my lawyer in the morning and then it will be Easy Street for me!
