BHMCruiser = Atticus. He used to bite, and hard. Woody runs this forum (I hope you know that much). BHM got caught up in a mass banning (what, 9 months ago now?) and got the boot for no particularly good reason, IMHO. His replacement Mud persona is like a caged wolverine, only fatter. Sedated. It's just cruel. Cultivating a good sense of humor on Mud would allow you to see him for what he is.

i doubt there are any statutory rules of the road in california that apply to avoiding overhead obstacles on private property.

the parking garage owner has a duty of care to provide adequate signage to warn of any unexpected hazard in the garage. the duty is commensurate with the extent of the hazard and the extent to which it departs from a driver's normal expectationst. a change in clearance height inside a parking garage would qualify for such a duty and would probably impose a fairly rigorous obligation to take care to bring it to the attention of a driver. if the owner put a small sign in a place that could foreseeably be blocked by a vehicle, even if it was illegally parked, they likely breached that duty of care if there was a better place they could have put the sign.

so, get some photos of the sign location, park a minivan there, then take the owner to small claims court. unless state law requires you to join joint tortfeasors in a lawsuit, let the owner bring the illegally parked car into the lawsuit. on these facts, unless state law says otherwise, the parking lot owner will be jointly liable with any liability of the illegally parked car and you can collect 100% from him. so you don't need to bother tracking down and suing the owner, unless you were contributorily negligent, which generally severs that joint liability.

i doubt the driver of the damaged vehicle would get any contributory negligence award against them here. It is difficult to visually judge the overhead height in a parking garage from inside a moving car and a driver has a reasonable expectation that he will be warned of a change in height and so need not take any special precautions.

the illegally parked driver breached a contractual duty with the parking garage not to park illegally but that doesn't automatically mean he is liable for the blocked sign. depending on the terms of that contract, which are probably posted on the wall of the garage or on the back of the parking ticket, and depending on how favourably state law treats those kind of sneaky standard form contracts, he or she may have a contractual duty to indemnify the parking garage for the damage.

if the contract does not cover it then i think it is 50/50 whether the illegally parked driver would be held liable in negligence either to the parking garage or the driver of the damaged vehicle. ordinarily parking in an illegal spot does not have consequences for other drivers, so in this case, before you could impose a duty of care on that driver, you would have to prove that the damage that was suffered from the blocked sign was a reasonably foreseeable consequence of parking in the forbidden area. that might be hard to prove.

this is, of course, all subject to any local statutory law modifying the common law in respect of occupier's liability, negligence or other tort reform.

Something similar happened to me when I was driving a state van in Utah when I entered a parking terrace.

I was fine on the first level, but as I ascended up to the 2nd level I noticed the ceiling getting closer and closer to me until it finally went squish. Good thing I was driving like a granny.

BTW, that was the 2nd time I screwed up driving one of their vehicles. I already wasn't a good driver then.

BTW, I didn't read through all of these pages.

Far as I'm concerned, yer old lady did you a huge favor. Better to have that thing ripped off in a low-speed ruckus than with two kayaks on the freeway. You may have noticed that one night we met at the gas station, that I didn't have a factory rack. I had one up until a couple months ago. I figured that, since the rack said "100 lbs. capacity" on it, it could easily handle a couple of 30 lb. surfboards. What I understood was that two 30 lb. surfboards would create 60 lbs. of downward force on the rack when the truck was static. What I did not take into account was that two 11'+ longboards, with the tails directly over the windshield, would create much more upward pressure, effectively creating a visor-like air catch above the sunroof. The four front nutserts are not equipped to handle the God-only-knows how many lbs. of upward force that have been subjected to them after 3 1/2 years of multiple longboard transport.

So, driving up the 101 Freeway, when I heard an ungodly flapping coming from the roof, I pulled over. Thankfully, one front nutsert and the four rears came to the rescue (they gave their all, they surely did, and that was obvious when they were removed--just tweaked to death but holding), or I would have lost two surfboards and the roof rack on the freeway, and Lord knows what might have happened to the people behind me. It could have been an awful mess. Thanks, Toyota, for making a product that could stand up to years of my thoughtless stupidity!

So, kiss your wife on the cheek, say "Thanks honey", get it painted (who gives a shit what it looks like, Wilt Chamberlain is dead), and get that Inti Rack you have been drooling over on Henry's website.

Hell, maybe you can guilt-trip Mama into writin' you a little check! I know I would!

PS--It is your wife that is the liar. Nice story with the parking structure, but you and I both know in our hearts that the roof rack was ripped off while she was having a mad roof-top tryst with her Sumo instructor, Debuchinpo-san.

I've never seen it happen but my wife drives PCH twice a day 5/6/7 days a week. She said she has seen a few surfboard close calls

Yeah, Henry (Exiled) had a 60, with an Inti rack on his website (maybe it was a thread, I dunno)...

In any case, I meant Alvaro (La Cabra)'s website, not Henry's. They're both Latin American, so I got them mixed up.

here's the thing....thread titles that are misleading as to the content should have some kind of red light flashing next to them cause otherwise I miss all the good stuff.
