Actually, FALCPA does not recognize spelt as a wheat alternative, and if your product contains spelt, you are supposed to claim it as a wheat allergen.
"..the Food and Drug Administration ruled in March of 2006 that spelt is to be classified as wheat under the auspices of FALCPA section 201(qq). The FDA arrived at this decision as a result of a challenge brought by Purity Foods of Okemos, MI, who contended that their product "VitaSpelt" should be exempt from allergen declarations under section 403(w)(7) of FALCPA since, in their opinion, spelt should not be considered wheat due to taxonomic considerations. That notwithstanding, there are still some who maintain that spelt is suitable for use by those who suffer from celiac disease or a wheat sensitivity. In the above referenced decision (Purity), the FDA cites evidence that spelt has been found to be >95% genetically identical to "common wheat," and that one sequence of a spelt protein is >99% identical to a homologous wheat protein that is a known wheat allergen. So, while some claim they do not experience symptoms of celiac disease or wheat sensitivity after eating spelt, the scientific evidence seems to solidly call into question the wisdom of making health decisions based upon anecdotal claims such as these..."
So by having spelt in the bread, and not declaring a wheat allergen on the packaging, they have broken FALCPA, and are thus recalling the product.
