I would say if you had all the service records on your old engine showing that it was cared for by the book then you could insist on a new engine. But if you bought it used and have no records then a rebuild or salvage engine would be great.

well, a rebuild engine would be OK if it comes with a warranty and was done by a reputable company.
Salvage... I'd stay away. How do you prove it's "equivalent" to your old one or even near as good...? Complete unknown...

At a dealer I'm sure the rebuild will be from a Toyota depot with Toyota parts. For you a much better deal. But a LKQ salvage from another 100 is probably fair as long as they warrant it for a little while.

Update
The dealership put in a LKQ motor with 75k on it, 1 year warranty. The service manager tried for a new motor and I asked the insurance co about the price difference but it was like $5K. The dealer changed the water pump and timing belt, new belts and caskets and plugs. He changed the starter contacts as well. Took about 6 weeks and they drove it to Nashville to pick up their minivan. Cost the insurance co about $7k, no cost to me. Can't really complain about anything, good professional communication and the dealer detailed and dropped it off with a full tank of gas. It runs so sweet and strong, much better than when I took it to them. Thanks for your interest.

Good for you! That should last you for years and most of the 90K is already done.

Wow, good for you. There apparently are somepeople out there that chose to do the right thing. I too am glad it worked in your favor. I know it maybe in this thread somewhere but would you mind giving a call-out to this dealership so we can all put them on the good-guy-to-deal-with list?
Plus a free loaner car for months. Win-win for you. That's why I buy Toyotas.

Stokes Brown Toyota is the dealership in Bluffton SC on HWY 178, Rob Whiddon is the service manager. The shop foreman went to work for Toyota factory and my truck was one of his last jobs. Cool guy, we got along pretty good and he really knew his stuff. I think he adjusted a computer or something, the truck will absolutely fly now.
We were very fortunate. I had just bought the cruiser about 6 monthes before from a Landrover Dealership for $13k. It had sat a while and they probably took it to the cheapest place in town for the previous oil change which probably is to blame for the whole mess. I have had many 40's, two 42's, a 55, a 60 and a 62(all rust buckets but I loved everyone of them) but the 100 was a stepup for sure. It was so sweet to get such a nice car and I was ill when this happened. But they made it right.

I need to correct, I had bought the truck in July so I owned the truck about 2 mths before the oil change. We had put about 2000 miles on the engine.

Congrats on the engine. We had a oil gasket fall into a cylinder and cuased the engine to fry going down the interstate. Porsche agreed to fix it becuase they had too just changed the oil. I think it took about 4 months to get everything in. They put a brand new engine in. And just like yours, it drove better, and man did it fly. felt much much faster

How the heck does an oil gasket fall into a cylinder on a 997? I'm trying to figure out how the physics of it would work, since the oil filter is at the top of the motor, and the cylinders are mounted horizontally, not even allowing anything to fall "into it".

996, it was a 2003 C4S. Dont know how it happened but porche replaced the whole engine.
it was a gasket of something i remember that. im thinking it was a oil gasket.

sorry ol' chap. Anyways, 100 tech content - I use OEM filter with Mobil 1 oil and dont have the dealer do it. I freaked out when they decided to change my oil when I got the 90k done last year. I demanded my $ back for the filter+oil because I specifically told them not to.

New motor
Same thing happened to a guy who worked for me on his 02 at a dealership. Old oil filter gasket was the culprit.
However the dealer tried to cheap out & give him a new head & cam. He knew nothing about cars & brought it by for me to listen to. Sounded like crap. They screwed around with it some more & sent him on his way. A week later the thing fried on the highway. That was actually a good thing, he ended up forcing them to pay full KBB price towards a 04' trade.
As much as the dealers can suck, I'd rahter pay $10 more for an oil change there, than at junky lube or some where else. If you had a catastrophe due to their fault I'd rather be dealing with Toyota.

They ruined a perfectly good engine, and they are wanting to replace it with a used engine which you know nothing of the history. If I were you, I would push for a brand new Toyota engine, at least the long block and have them install all the useable good stuff off the current engine. Remember, THEY are at fault, not you. Don't SETTLE for what they want to give you, they are only trying to keep THEIR costs down.

Sounds like everything worked out for you. I have been following along and am impressed with the way that both sides handled this situation. I would like to believe that most toyota dealerships would do as much.
Most large dealers are actually self insured. They use an insurance company to administer claims but the money all comes off of the bottom line. might make some of you appreciate the honesty and outcome even more.

You wouldn't have a choice. It's insurance. When they total your car, you don't get a brand new car in replacement, you get the current value of the car. Same thing here. Sure it's their fault, but all they are obligated to do is put you back out the door in an equivalent state to when you came in.
Plus there's a lot to be said for agreeing to a good compromise. If you're the a-hole that sues the dealership to get a new motor, what kind of service do you think you're going to get from then on out? Or, if you're the guy that worked with them on a good compromise, if you've got issues down the road, you're probably going to get better service.
